TERMS AND CONDITIONS OF MISSISSAUAGA
RAMBLERS
Waiver and Indemnity
Cricket involves the risk of both minor and serious physical injury as a result of play
(which
may include permanent bodily injury, permanent paralysis, or even death). While protective
equipment is worn and care is taken to avoid injury, participants may be injured in a number
of
ways, including, but not limited to, being struck by the ball; from running between the
wickets
or fielding; in a collision with other players, the boundary or the stumps; through
repetitive
strain type injuries and through injuries resulting from the failure of equipment.
Players may be injured during official matches played in leagues that Mississauga Ramblers
Cricket, Sports and Cultural Club (“Ramblers”) participates in, while representing Ramblers
in competitive or social games, during practices of Ramblers, or even while watching any of
these activities, as well as through any travel to and from games, tournaments or
participation in other events which are an integral part of Rambler’s activities, as well as
other related events and activities of Ramblers which may not be related to cricket
(referred to together as “Club Activities”). These injuries may result from the nature of
the sport of cricket and can occur without any fault on the part of Ramblers, the leagues
that Ramblers participate in or the City of Mississauga, or their respective directors,
officers, servants, employees, volunteers, officials, coaches or agents (all of which are
collectively referred to as the “Representatives”).
By agreeing to these Terms and Conditions and choosing to participate in the Club
Activities, you are assuming the risk of injury, both known and unknown, even if arising
from the negligence of the Representatives, and assume full responsibility for your
participation (or the participation of a minor that you are the parent/guardian of) in the
Club Activities.
By agreeing to these Terms and Conditions, you confirm that you understand and accept the
above and hereby release and agree to hold harmless the Representatives from any and all
claims, actions or damages, without any limitation whatsoever and no matter how caused,
whether consisting of loss, personal injury, property damage, permanent disability or death
arising from your participation (or the participation of a minor that you are the
parent/guardian of) in the Club Activities, even if arising from the act or omission, breach
of contract or negligence of the Representatives.
As a participant in the Club Activities, you agree to conduct yourself in an appropriate
manner at all times, showing the appropriate degree of respect to other persons and to the
facilities at which play is conducted. You will not willingly cause, or do anything which
might cause, any damage to the facilities, other players, spectators, coaches, or officials
of the Representatives, or to their reputations, and agree to indemnify any of these parties
for any damage you may cause to such facilities, persons and/or reputation. You agree that
if you engage in behavior which is not appropriate, you may be required to leave the
premises and prevented from returning, and you may no longer be permitted to participate in
the Club Activities sponsored or provided by, or through the facilities of, the
Representatives.
Privacy
By agreeing to these Terms and Conditions, you agree that Ramblers may use the information
you have provided and share such information with third parties (such as the leagues we play
in or the City of Mississauga) as required for the operation of Club Activities. Ramblers
will not otherwise share or disclose your personal information to any other third parties.
